FDA Plans to Revisit Its 2021 PMTA Rule: What Nicotine Suppliers Should Watch
On 28 September 2026, the U.S. FDA announced that it intends to evaluate changes to its Premarket Tobacco Product Application (PMTA) framework, including possible new rulemaking to replace the current rule. No proposal or timeline has been published yet, and the FDA will continue to review applications under the existing rules.
What the current PMTA rule covers
The current rule was published on 5 October 2021, took effect on 4 November 2021 and is codified in 21 CFR Part 1114. It sets out what an application must contain, how the FDA reviews it and what must be reported after a product is on the market. Every new e-cigarette, e-liquid and nicotine pouch needs a PMTA marketing order before it can be legally sold in the United States.
Why the FDA is reviewing the rule
- Its experience of applying the 2021 rule.
- A federal lawsuit filed on 2 September 2026 in the Northern District of Texas that seeks to vacate the 2021 rule.
- A Fifth Circuit ruling on 19 August 2026 (NicQuid v. FDA) that the FDA’s comparative efficacy standard must be adopted through formal rulemaking.
- The growth of an illicit, unregulated market and the pace of new product launches.
According to figures cited by the plaintiffs in the Texas case, about 130,900 PMTAs were awaiting decisions as of 31 March 2026.
What will not change
The 180-day review deadline and the public health standard come from law, so a new rule cannot remove them. The FDA has also said any change will include public input. Until a new rule is final, the current requirements stay in force.
What nicotine suppliers and buyers should watch
- Any proposed rule and its comment period.
- The Texas court’s decision on the request to vacate the 2021 rule.
- Changes to what product makers must document about ingredients, including nicotine source, purity and impurity testing.
Whatever the outcome, buyers will keep needing complete batch documents. Suppliers who already provide a COA, specification sheet, SDS and batch traceability will be best placed for any new requirements. Buyers can check this before they enquire on the Trade Nicotine B2B marketplace.
